Terms & Conditions of business

1 GENERAL

1.1 These Terms and Conditions apply to the booking of any activities provided by JXL T/A Jump Xtreme & That Fun Place (“Jump Xtreme”) Company number 11471541 whose registered office is located at Jupiter House, High Street, Tattenhall, Chester, Cheshire, CH3 9PX and any and all ancillary products at the location set out in Jump Xtreme’s booking confirmation (the ‘Activities”).

1.2 These Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Terms and Conditions.

1.3 Any clerical or other error or omission in any booking confirmation or other documentation issued by Jump Xtreme (including any electronic documentation) shall be subject to correction without any liability on the part of Jump Xtreme.

1.4 Jump Xtreme reserves the right to make changes to the Activities whether to conform to any applicable safety or other statutory requirements or otherwise.

1.5 No variation to these Terms and Conditions shall be binding unless agreed in writing by Jump Xtreme

2 CONFIRMATION OF BOOKING

2.1 No booking shall be deemed to have been accepted unless accepted in writing by Jump Xtreme (which shall include Jump Xtreme’s email confirmation of booking).

2.2 These Terms and Conditions incorporate Jump Xtreme’s Privacy Policy, and Risk Acknowledgement and Disclaimer. You and each member of your party will be required to sign the Risk Acknowledgement and Disclaimer before being allowed to undertake the activities.

2.3 You must advise Jump Xtreme as soon as possible of any mistake in Jump Xtreme’s booking confirmation. Jump Xtreme shall use its reasonable endeavours to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive at least 25 minutes before the time booked to allow time for checking in and safety briefings. Late arrivals may not be permitted to undertake the activities and no refunds or compensation for consequential losses, travel expenses or any other ancillary expenses will be payable in such circumstances.

3 SAFETY

3.1 The activities comprise physically challenging trampoline activities and participation is not without risk. Falls can result in serious injury, paralysis, or death. All participants will receive a detailed safety briefing, and the safety rules set out in our Risk Acknowledgement and Disclaimer must be always complied with.

3.2 Jump Xtreme reserves the right to refuse admittance to the activities or to remove a participant from the activities should it deem it necessary to do so.  This includes a participant who does not comply with the safety rules and advice, the safety system or who is deemed to be under the influence of drugs or alcohol.

3.3 After the safety briefing participants will not be directly supervised by an instructor or member of Jump Xtreme’s staff. A participating adult must accompany all under 5-year-olds. One adult is permitted to supervise a maximum of ten under 16-year-olds. Supervising adults (whether participating or spectating) must sign a Risk Acknowledgement and Disclaimer stating that he or she will accept responsibility for their safety and the supervision of children in their care.

3.4 To use the main jump arena at peak times, all participants must be reasonably fit and healthy, at least 4 years old and must weigh less than 20.5 stones/130kg. If you have any concerns, we advise that you visit our site at a time before your booking and speak to a member of the Jump Xtreme staff. Anyone who does not meet these requirements will not be allowed to undertake the activities. It is your responsibility to ensure that all members of your party meet these requirements.

3.5 During off-peak periods Jump Xtreme operates dedicated sessions for toddlers during which children of any age deemed safe by the participating adult will be allowed on the main jump arena. The participating adult must supervise any toddlers participating in these sessions directly by participating in the session at all times.

3.6 All participants are required to wear Jump Xtreme jump socks for grip and hygiene.

3.7 The activities are physically demanding and require a degree of agility, strength and stamina. Participants are advised to jump within their ability – only the individual knows or understands their limits and competencies. If you are unsure of whether you can complete a manoeuvre, you should not attempt it. If participants have medical concerns, they are advised to consult their doctor in advance.

3.8 Participants certify that they do not suffer from any medical condition which would make it more likely that they would be involved in an incident that could result in injury to themselves or others.

3.9 Due to the physical nature of the activities, pregnant women should not take part.

3.10 Participants need to be able to see similar distances to those required to drive a car to be able to complete the activity and to supervise any under 16’s in their care. Consequently, short- or long-sighted participants must ensure that they wear contact lenses or prescribed glasses, which must be sports-type shatterproof glasses.

3.11 All participants are required to always act responsibly and courteously and to respect other participants. Jump Xtreme shall be entitled to prevent any person from undertaking or completing the activities in the event it deems the behaviour of any participant unsuitable.

3.12 Participants must be dressed appropriately (See 4.1) and Jump Xtreme reserves the right to refuse admittance to the activities to any participant who is not appropriately dressed.

3.13 No refunds or compensation will be payable by Jump Xtreme if any participant is not permitted to, or decides not to, undertake, or complete the activities for the reasons set out in this clause.

3.14 We welcome all children/adults with special needs. However, they must be accompanied and supervised AT ALL TIMES by a responsible carer (age 18 years plus).  At peak times we may not be able to accommodate children or adults with special needs for safety reasons so please contact the park before booking and speak with a member of staff.

3.15 Children always remain the responsibility of parents or guardians and Jump Xtreme does not provide supervision at any time.

 

4 CLOTHING

4.1 It shall be the responsibility of all participants to ensure that they are dressed appropriately and Jump Xtreme advises participants to wear clothing appropriate for the activity and which they do not mind getting damaged. In particular, the following restrictions shall apply:

a) Participants must wear Jump Xtreme grip socks for grip and hygiene
b) Long hair must be tied back
c) No belts, jewellery or other sharp items of clothing that may cause
damage to yourself, the equipment, or other participants.

4.2 Jump Xtreme trampolines are abrasive and Jump Xtreme will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the activities.

5 CANCELLATIONS

5.1 For cancellations of more than 3 days before the class or session, the session can be transferred to another date.  Cancellations made with less than 3 days’ notice are not entitled to a refund or a transfer. This also applies to latecomers and non-attendees and those booked on a 2-hour Free Jump session but do not complete it. If a booking is made with less than 3 days notice then no refund or credit will be given for non attendees

5.2 Jump Xtreme reserves the right to cancel your booking at any time. If Jump Xtreme decides to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. Unless the cancellation has been caused by force majeure, then you shall be entitled to a full refund in the event of cancellation under this clause, but no other compensation shall be payable.

5.3 if it proves necessary to close the activities for reasons beyond the control of Jump Xtreme, you shall not be entitled to any refund (in part or whole). In such circumstances, Jump Xtreme may, but shall not be obliged to, offer alternative dates or times at reduced rates.

6 PRICE AND PAYMENT

6.1 Subject to any terms agreed in writing between Jump Xtreme and you, our charges shall be calculated at our current rates and payment in full shall be due at the time of booking. The charges include the cost of purchasing the activities. Payment may be made by debit or credit card either online or by contacting the respective site.

6.2 Should our rates change for an activity between the date of booking and the date of the activities, no additional fee will be payable in the event of any increase, nor will any refund be made if the rate has decreased.

6.3 Jump Xtreme is unable to replace or reimburse the value of a gift voucher if it’s lost, stolen or damaged – please look after it carefully and treat it just like cash.

7 GROUP AND PARTY BOOKINgS

7.1 If Jump Xtreme is providing catering for your group, any specific dietary requirements must be communicated at the time of booking to ensure these requirements are met where possible. Failure to provide adequate notice of any changes to dietary requirements may lead to an inability to meet your requirements.

7.2 Should a group want to make amendments to their catering options, a minimum of 7 days’ notice must be provided.

7.3 The number of guests must not fall below 10.

7.3.1 A party or event may proceed with fewer than 10 participants, but a minimum charge will apply equivalent to the rate for 10 participants.

7.3.2 All changes are made in accordance with the refund and transfer policy.

7.4 Parties or events: A party is required to present themselves to a member of staff 30 minutes before the confirmed party start time. Rights of admission can be refused at any time in the case of excessive lateness.

7.5  The party area must be promptly vacated at the end of the party session to allow preparation for the next users. There is no guarantee that you will be able to have the room for any length of time before the party.

7.6 Jump Xtreme will permit birthday cakes to be brought in by participants, but all other catering must be provided by Jump Xtreme.

7.7 Party or event participants under the age of 18 remain under the supervision of an adult and the party organiser must ensure sufficient adults remain with the party to supervise the number of participants.

7.8 A minimum of 50% non-refundable deposit is required at the time of booking to secure a party or group booking, with the balance due a minimum of 14 days before the party. The final number of participants you pay for and any extras are both non-refundable once paid.

7.8.1 If a party is booked with less than 14 days’ notice, then full payment is required at the time of booking.

7.8.2 There is no guarantee that we can add extra participants on the day so please make your local park aware of any possible number change before the day.

7.9 Any offers or promotions that we run in the park and online do not apply to bookings already made.

7.10 A completed waiver is required for all participants on the trampolines. Please ensure that one is completed online before attending. Your party host will double-check these on the day as your child will not be allowed to jump without a valid waiver.

7.11 Please ensure you book the correct birthday party for your child as there are age restrictions for certain parties. NO under 4’s are permitted on the trampolines in a Jump or Combi Party.

 

8 REFUNDS AND AMENDMENTS

8.1 Payments made by debit or credit card will be refunded to the same card or, if the card has subsequently expired, by cheque. Payments made by Gift Voucher will be refunded by the issuing of a replacement Gift Voucher to the same value.

8.2 Where multiple forms of payment are used, Jump Xtreme reserves the right to refund any monies due on a refund or amendment by credit or cheque at its discretion.

8.3 Where a refund is made by cheque, it will be dispatched within 14 days and can only be made payable to the participant named on the original.

9 LIABILITIES

9.1 Jump Xtreme provides activities and products without any warranties, express or implied statutory rights are unaffected by these Terms and Conditions. Except as otherwise provided in these Terms and Conditions Jump Xtreme shall not be responsible for the loss, or damage, of or to any property or any person arising from the booking of or participation in the activities.

9.2 Use of the parking facilities and any vehicles are left at the owners’ risk and subject to any conditions and the payment of any fees as may be required by the provider of such facilities at the site location.

9.3 Lockers are provided for the convenience of our customers. Any items left in the lockers are left at the owners’ risk and Jump Xtreme will not accept any liability for loss or damage of any items howsoever caused.

9.4 Except as otherwise provided in these Terms and Conditions, any liability of Jump Xtreme shall be limited to the refund of any charges paid to Jump Xtreme.

9.5 Nothing contained in these Terms and Conditions is intended to nor shall limit the liability of Jump Xtreme in respect of death or personal injury caused by the negligence of Jump Xtreme or its employees, agents, or contractors.

10 MISCELLANEOUS

10.1 If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force, and continue to be binding and enforceable.

10.2 Participants consent to the collection of personal data to maintain records of who has completed Risk Acknowledgement and Disclaimers on behalf of themselves and any minors in their care and for marketing purposes.

10.3 The participant consents and agrees to the use by Jump Xtreme of CCTV monitoring for health and safety, training, and security purposes. Jump Xtreme consents to the participant and members of their group undertaking photography for their own non-commercial purposes only and for no other purpose whatsoever.

10.4 Nothing above shall confer on any third party any benefit or the right to enforce any of these Terms and Conditions.

10.5 We do not sell any personal information collected within the parks to any 3rd party groups, all information is for internal use only.

10.6 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

10.7 Only food and drink purchased at Jump Xtreme is to be consumed on the premises (Excluding baby food/birthday cake).

10.8 You submit to the exclusive jurisdiction of the courts of England and Wales.

10.9 Jump Xtreme reserves the right to make alterations to the Terms and Conditions at any time.

10.10 The Jump & Dine offer cannot be used in conjunction with any other promotions/offers/vouchers or discounted group bookings.

10.11 Any offers or promotions that we run in the park and online do not apply to bookings already made.

11 THAT FUN PLACE

11.1 All children need to be supervised at all times by a responsible adult - No unaccompanied children.

11.2 No unruly behaviour - please respect others at all times.  Any child whose behaviour is unacceptable, may be asked to leave and no refunds will be issued in such circumstances.

11.3 Once your 2-hour session has been booked and paid for no refunds will be issued if the session is not fully completed unless this is due to the park itself. If you chose not to complete your 2-hour session you are not entitled to a refund.

11.4 We recommend the area is suitable for ages 0-12 years however we may accommodate older ages at the discretion of the manager.

11.5 Appropriate clothing and socks must be worn at all times - no bare feet.

11.6 At the end of the paid session a further session charge will become payable if you choose not to leave.

12 GIFT VOUCHERS

12.1 Jump Xtreme & That Fun Place Gift Vouchers can be used as full or part payment for activities (excluding concessions, food & drinks).

12.2 No change or refunds will be given but any balance remaining on the voucher may be applied to future purchases.

12.3 Gift vouchers may not be exchanged for cash.

12.4 Jump Xtreme & That Fun Place are unable to replace or reimburse the value of your voucher if it is lost, stolen or damaged – please look after your voucher carefully and treat it like cash.

12.5 Vouchers are valid for 12 months from the date of issue.

13 FORCE MAJEURE

13.1  Jump Xtreme shall not  be liable for any breach of its obligations under these Terms and Conditions where it is hindered or prevented from carrying out its obligations by any cause outside its reasonable control, including, without limitations, acts of God, acts of government or other competent regulatory authority, lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law or regulation and accident (or by any damage caused by any of such events). Where a booking cannot be fulfilled for this reason by Jump Xtreme, a refund will not be given, but Jump Xtreme shall at its sole discretion offer an alternative time and date to fulfil the booking.

    All purchases made by JXL Ltd, shall be governed by these terms.

  2. Terms of Purchase

    1. Purchase Orders or contracts shall not be binding, unless signed in writing, or sent directly by e-mail by a director of the company.

    2. The company shall not accept any liability for consequential losses, in the event of an order being cancelled by the company, however so caused.

  3. General Terms

    1. No variation to these terms shall be effective unless agreed in writing by a company director

    2. These terms of purchase shall be governed by and construed in accordance with the laws of England. Any delay or forbearance by the company in enforcing rights or obligations under these terms of purchase shall not be construed as a waiver of that right or obligation or of a right to enforce such right or obligation at any time thereafter.

    3. If any of these clauses or conditions is not legally effective, the remainder of them shall be effective. The Company can replace any clause or condition that is not legally effective with a clause or condition of similar meaning that is. If a suppliers terms conflict with these standard terms, unless specifically agreed in writing the supplier agrees these terms shall prevail.

    4. Every effort will be made to carry out the contract but its due performance is subject to cancellation by us or to such variation as we may find necessary as a result of inability to secure labour, materials, or supplies or as a result of any Act of God, War, Strike, Lock-out or other labour dispute, Fire, Flood, Drought, Legislation or other cause (whether of the foregoing class or not) beyond our control.

    5. Title to goods purchased passes immediately on delivery to the Company, and the seller of the goods acknowledges the right of The Company to remove goods from the sellers premises in the event of non-delivery. The seller warrants that it has good title to any goods sold to The Company and the seller alone shall be responsible to any 3rd parties for any disputes regarding title to goods sold to The Company

    6. The Company’s normal payment terms for goods supplied is 60 days from the date of supply unless otherwise agreed in writing with a director.
